ARTICLE 1: GENERAL PROVISIONS
These General Terms and Conditions of Sale apply to individual bookings equal to or less than 5 rooms, made in one go, concluded directly at the HOTEL MAISON LACASSAGNE. or on our website www.hotel-maisonlacassagne.fr. Online bookings can be made until 23:00 for same-day arrival.
The customer undertakes to comply with and enforce all the provisions set out in this document, as well as the legal and regulatory requirements.
These conditions of sale are subject to change at any time, and the applicable conditions will be those in force on the date the reservation is made.
These general conditions of sale, will prevail over any other general conditions of sale, not expressly approved by the HOTEL MAISON LACASSAGNE
ARTICLE 2: CAPACITY
The client acknowledges having the capacity to contract, that is to say to have the legal majority and not to be under curatorship or guardianship.
ARTICLE 3: BOOKING CONDITIONS
The rates charged are established in euros (€) per room per night, the tourist tax is extra. The prices charged are only for the services strictly mentioned in the reservation.
The rates mentioned on the site are subject to change without notice and only the price mentioned in the booking confirmation is contractual.
The reservation will only be effective if the customer guarantees his reservation, by communicating a credit card number with validity date, valid at the time of the customer’s stay. The hotel reserves the right to refuse any reservation in the event that the credit card number is incorrect.
Upon registration of the reservation, a credit card debit authorization will be made. This authorization will be made for informational purposes, and will not constitute, in any case, a debit of the account (except in case of reservation at the promotional rates non-cancellable, non-modifiable and in total prepayment at the time of booking).
At certain periods, the prepayment of the stay will be requested (non-refundable).
For stays of 5 nights or more, the total prepayment is required, and is non-refundable, in case of cancellation.
ARTICLE 4: PROVISION OF ROOMS
Rooms are available from 2 p.m. on the day of arrival and must be vacated no later than 12 p.m. on the day of departure.
ARTICLE 5: CANCELLATION CONDITIONS
If the reservation is made on our website www.hotel-maisonlacassagne.fr it is desirable to cancel it by this means, by clicking on “modification or cancellation”. You can also cancel your reservation with the hotel.
Please note that some rates do not allow any modification, cancellation – full prepayment is required at the time of booking.
No fee is applied if the reservation is cancelled 1 day before the arrival date, before 5 pm (local time). After this period, the first night will be charged. At certain periods (exhibition periods), this period will be advanced to 7 days before arrival.
The date of receipt of the cancellation request (by email, mail, telephone, fax) will be the date chosen for the effective cancellation of the reservation.
In case of no-show of the customer at the hotel and in the absence of cancellation, the amount of the 1st night will be charged within the above deadlines.
ARTICLE 6: TERMS OF PAYMENT
Payment for all services will be made directly to the hotel (except for reservations pre payable at the time of booking).
Payment on the site is made by credit card and via a secure payment system.
ARTICLE 7: RELOCATION
In case of force majeure of exceptional event or technical problems in the hotel making it impossible for the customer to stay, the hotel will make every effort to find alternative accommodation, if possible in a hotel of the same or higher category. The costs of relocation (additional fee) will be borne by the hotel.
ARTICLE 8: DATA PROCESSING AND FREEDOMS
In application of the law 78-17, known as informatique et libertés, customers are warned that their reservation is subject to computerized nominative processing. Users have a right of access and rectification of the data entered, which is exercised at the registered office of the company. It is specified that this information is not communicated to third parties.
ARTICLE 9: CLAIMS
Any complaint must be sent by registered mail A / R to HOTEL MAISON LACASSAGNE.245 Avenue Lacassagne 69003 Lyon no later than 15 days after the date of departure. After this period, no claim can be taken into account.
ARTICLE 10: INSURANCE – RESPONSIBILITIES
The hotel declines all responsibility in case of theft, loss, degradation of the effects belonging to the customers during their stay.
The customer will be held responsible for any damage, any degradation, any act of vandalism that may occur due to the occupation of the premises and / or the fact of the participants and / or staff for whom he is responsible, both property damage resulting from the use of the Internet such as loss of data, virus, service disruption…
ARTICLE 11: RECOMMENDATIONS
The customer undertakes not to invite any person whose behavior is likely to harm the establishment, the hotelier reserving the right to intervene if necessary.
ARTICLE 12: INTELLECTUAL PROPERTY
Regarding the use of the website, the company HOTEL MAISON LACASSAGNE. is the owner of all intellectual property rights relating to the site.
The elements accessible on the site, in the form of texts, photographs, images, sound icons, videos, software, databases, are also protected by intellectual and industrial property rights.
Unless expressly agreed, written by HOTEL MAISON LACASSAGNE, it is expressly forbidden to reproduce, exploit, distribute or use for any purpose whatsoever, even partially, elements present on the site, or to disseminate a simple hypertext link.
ARTICLE 13: ATTRIBUTION OF COMPETENCE
Disputes that may arise from the application or interpretation of these general conditions of sale will be subject to French law and will fall under the exclusive jurisdiction of the French courts, within the jurisdiction of the Court of Appeal of Nanterre.
REGISTRATION FORM :
On arrival at the establishment, the customer must sign the registration form (police form)
after checking the accuracy of the information that has been pre-filled in and after amending it modified if necessary.
In the event that the customer refuses to complete or sign the policy form, the customer form, the customer acknowledges that he/she has been informed that the establishment shall be entitled to refuse to make the reserved accommodation available to him/her of the accommodation booked.
VERIFICATION OF MEANS OF PAYMENT :
In the event of payment to the establishment or any other entity, each establishment or any other entity may accept different means of payment but the customer must present to the establishment the bank card that enabled him/her to guarantee the reservation or to make the prepayment. The establishment may also ask the customer to show proof of identity for the purposes of purposes of preventing bank card fraud.
PRE-AUTHORISATION :
It’s up to each establishment to define the rules relating to pre-authorisation.
If the customer has not prepaid for their stay online, the establishment may, on the day of the customer's arrival, request authorisation (also known as "pre-authorisation") from the customer's bank for the credit card up to the amount of the reservation and a lump sum to cover any consumption or expenses incurred by the customer on site (breakfast if not included in the price, restaurant, bar, tourist tax if applicable, etc.). This fixed amount is determined by the establishment according to the number of people and the number of nights booked.
Example : 2 nights at 130 euros + 40 euros estimated for extras = request for authorisation of 300 euros.
The pre-authorisation request is not an immediate debit but corresponds to a reserve or deposit for subsequent payment, authorised by the customer's bank, which temporarily reduces the limit on the bank card used to guarantee the possibility of a subsequent debit. In some cases, however, depending on the customer's bank, the pre-authorisation request may appear as a pending debit on the bank account associated with the card used.
When the pre-authorisation request has been activated and confirmed by the bank either :
- The customer turns up at the establishment, payment for the entire stay is made directly to the establishment on the day of arrival or departure depending on the establishment, which then proceeds to a request to release the pre-authorisation request to the Customer's bank. Any consumption or expenses incurred by the Customer on site must be paid by the customer to the establishment on the day of departure ;
- The customer does not arrive at the establishment on the first day of the booking, the establishment will send a debit request to the customer's bank. In rare cases, the request of pre-authorisation may result in a debit by the customer's bank before the actual debit is made. In this case, the debit will not be made twice. The balance, if it is in favour of the customer,
will be automatically credited back to the customer by the bank.
